Assisted Living & Long-Term Care

The Goulston & Storrs Assisted Living and Long-Term Care group assists hospitals, trade associations, managed care and health maintenance organizations, home health agencies, telemedicine providers, technology transfer offices, health information technology companies, research foundations, medical device companies and specialty care providers. Additionally, we counsel long-term care, assisted living and nursing home providers, physicians, dentists and other healthcare practitioners (both individual practitioners and group practices).

Goulston & Storrs advises both family-owned and national companies with the development, financing, tax planning (for both taxable and tax-exempt entities), regulatory compliance, licensure and certification, and management and operation of alternative housing options for the elderly, assisted living residences, nursing homes and retirement communities. We counsel on day-to-day operational issues, assembling tax credits, tax-exempt bonds, Medicaid waiver financing, employee benefits and resident relations. Additionally, we handle issues pertaining to development and expansion, zoning, permitting, financing, licensing and certification of new facilities.

Representative Projects and Transactions

  • Wrote the chapter in the Massachusetts Continuing Legal Education treatise in connection with assisted living. 
  • Representation of a regional, not-for-profit housing development organization in the development of a 64-unit new construction assisted living project in the suburbs of Boston.
  • Representation of a Boston affordable senior housing organization in the construction of a new 150-unit senior independent living project in the suburbs of Boston, which offers a service-enriched living environment.
  • Involvement in substantial public subsidies, as well as solar and other energy efficiency installations and related tax credits for Shillman House, a senior independent living community located in the Nobscot Village area of the suburbs of Boston.
  • Involvement in the ownership change and financing for Allerton House, an assisted living facility located in the suburbs of Boston.
  • Involvement in the major revisions to the resident documentation for the Village at Duxbury, a lifestyle community for independent people ages 62 and up.
  • Representation of a leading real estate development and investment firm in the permitting, development and litigation of a mixed-use project constructed on the site of Waterstone at Wellesley, an independent and assisted living project located in Wellesley, MA.
  • Representation of a Boston-based community development corporation in all aspects of the development of Quincy Commons, an elderly affordable rental housing project located in Dorchester, MA.
  • Representation of a large commercial contracting firm and a well-known developer in the permitting, development and financing of Paxton Senor Living.
