Overview

Marshall Senterfitt is an Associate in the Litigation Group. His practice focuses on complex litigation matters, including partnership and closely held corporation disputes, real property matters, environmental litigation, state and federal employment issues and commercial contract cases. Mr. Senterfitt has represented clients in state and federal court, as well as in administrative agency proceedings and in alternative dispute resolution.

Representative Experience

• Won a multi-million dollar arbitration award for the co-founder and president of a closely held corporation in a breach of contract and fiduciary duty case.
• Obtained and successfully defended development approval from city Conservation Commission and the Massachusetts Department of Environmental Protection for the construction of 100,00+ square foot retail store.
• Obtained a favorable settlement of an enforcement action brought by the Massachusetts Department of Environmental Protection against an airport fueling company. 
• Counseled a national manufacturer of computers and computer components during settlement negotiations of CERCLA claims arising from historic use of a Superfund site. 
• Achieved the dismissal of a complaint against a manufacturer of construction materials in a UCC contract and breach of warranty matter. 
• Negotiated a favorable settlement of claims against a worldwide distributor of electronic and technology products in a breach of contract and breach of warranty case. 
• Consults with and prepares expert witnesses in environmental, land use, real property and complex business litigation.
• Counsels clients on a variety of state and federal employment issues, including bankruptcy and sale of business matters involving mass layoffs and plant closings.
