Representative Projects and Transactions

  • Representation of the owners of one of Boston’s largest buildings in a defense against claims of a curtainwall subcontractor and its surety. This extensive litigation required sophisticated document control and scheduling analysis and included multiple parties, nation-wide depositions, multiple experts over 100-plus days of trial.
  • General counsel to $500M general construction firm.
  • Representation of a major urban hospital in claim defense against a drywall and millwork subcontractor culminating in a multi-party mediation.
  • Representation of a large real estate development company in negotiating the construction contract for the base building work for an 800,000 square foot office development located on the Boston waterfront.
  • Representation of a real estate investment firm in developing standard agreements for construction contracts for residential condominium projects throughout the US.
  • Representation of a major rehabilitation hospital in defense of technically complex caisson and slurry wall subcontractor claims as well as masonry contractor claims.
  • Representation of a large developer in multiple building system failure claims. Sample matters include multiple party claims, investigation and litigation of switchgear fire, condenser water pipe flooding and bus duct damage.
  • Representation of a real estate investment company in negotiating construction and design agreements with respect to a mixed use (office/residential/retail) project in Waltham, Massachusetts; a residential condominium project in Boston; and both public and private construction and design contracts for Worcester Renaissance, a major mixed use redevelopment in Worcester, Massachusetts.
  • Representation of a medical research company in construction contract negotiations regarding a multi-phased project, including tenant fit-up in Lexington, Massachusetts. Also assisted client with construction and design agreements for multiple office and laboratory facilities and a new 92,000 warehouse fit-out in Massachusetts.
  • Assisted a Boston-area college with construction and design agreements for multiple repair and upgrade projects to a professional concert hall. Additionally, represented client in negotiating contracts for restoration of a residence hall and other college-owned buildings.
  • Representation of a public transportation authority in claims against the federal government in the United States Court of Federal Claims to recover for breach of contract, involving a federally sponsored project.
