BBA Webinar: Trusts & Estates End of Year Review 2021

Hosted by the Boston Bar Association, the annual Trusts & Estates End-of-Year Review covers recent federal and state case law, legislation and tax law matters.  This year’s program, featuring attorney John Ramsey, touched upon:

  • New Developments:  The committee reviewed recent cases involving the reformation of a supplemental needs trust, undue influence on a testator following the removal of two beneficiaries shortly before death, the inclusion of an adopted child as a descendant of the child’s biological grandmother’s trust, and the judicial review of a trustee’s actions in connection with a realty trust.
  • Public Policy:  The presentation included updates on the status of the Massachusetts Uniform Trust Decanting Act (MUTDA), Revised Uniform Fiduciary Access to Digital Assets ACT (RUFADAA), legislation pertaining to adopted children, the Massachusetts elective share, the Massachusetts estate tax, caregiver authorization affidavits, and other pending legislation relevant to Trusts & Estates practitioners.
  • Tax Law Updates: The committee reported on recent developments in federal tax law that are relevant to estate and tax planning, including proposed legislation, recent cases, and private letter rulings and other written determinations. Topics include the estate, gift, GST, and income taxes, life insurance and retirement assets, charitable planning, and/or procedure.
