This year marks the 51st International Council of Shopping Centers (ICSC) U.S. Law Conference. The conference provides retail real estate legal professionals the opportunity to gain industry-specific knowledge and insight from leading authorities and network with industry peers. The conference is November 3-5, and features various sessions and workshops for the retail and real estate legal community. 

Attorney David Rabinowitz is chair of the ICSC 2021 Conference. Several other Goulston & Storrs attorneys are speaking during the conference.

Workshop: Everyone Wants to Rule the World: Quest for Control in Supermarket Leasing
Date & Time: Wednesday, November 3, 2:00 - 3:15pm

As the supermarket business evolves post COVID, operators are expanding their control over all elements of the shopping center. This session will focus on controversies, including use provisions, common area rights, exclusives and restrictions and the impacts of the “new normal” on the grocery business. The speakers will also highlight compromises to facilitate flexibility for the balance of the shopping center while working within the demands of these industry giants.

Workshop: The COVID Litigation Update: Emerging Issues, Themes and Lessons

Just as COVID-19 has produced lasting changes to life as we knew it, it has forced us to reconsider what we thought were well-settled principles of law. The litigation came quickly and it filled courts across the country (remotely anyway). Like the pandemic itself, the results over the past 20 months have been unsettling for landlords and tenants alike. This general session will survey these decisions and provide predictions about what’s next.

Workshop: The Old vs. New Normal: Pros and Cons of Conforming Leases
Date & Time: November 5, 7:45-8:45am

Is conforming leases a good idea?  It depends.  If there is not a meeting of the minds, the cons of conforming a lease to a prior lease can outweigh the pros.  There are lots of considerations that would be made before agreement to conform leases, especially in COVID-world.  This roundtable will provide an opportunity to discuss all the relevant conforming lease considerations.
