Federal Court Rules in Favor of Goulston & Storrs’ Client NIKE, Inc., in “Legendary” Trademark Dispute

On September 30, 2014, the U.S. District Court for the Northern District of New York dismissed trademark infringement and unfair competition claims brought against NIKE, Inc. by Legends Are Forever, Inc. over alleged use of its “Legends Are Forever” mark. Senior District Judge Kahn held that there was no likelihood of consumer confusion between t-shirts in NIKE’s Kobe Bryant apparel line and Plaintiff’s Legends Are Forever baseball-themed products sold primarily from its store in Cooperstown, New York. NIKE was represented in this matter by Goulston & Storrs attorneys Jennifer Furey and Matthew Horvitz.   Click here to read the opinion.
