Goulston & Storrs Director Marshall Senterfitt was quoted in a Massachusetts Lawyers Weekly article “Appeals Court addresses issues of first impression in trust case” on December 9, 2021. In Matter of Colecchia Family Irrevocable Trust, the Appeals Court addresses three issues of first impression regarding disputes over trusts. However, the ruling also raises procedural questions of how parties will oppose trust petitions in the future.

Marshall was quoted in the article saying, “The court and practitioners will have to consider what this means for that part of the trust petition process going forward,” He added, “If there are specific provisions in one or the other of the MUPC and the [Massachusetts Uniform Trust Code] that have led to similar practices in probate and trust proceedings, people will have to continue to analyze which statute applies in which circumstances.”
